Terms & Conditions
These Terms and Conditions ("Agreement") govern your use of the services provided by Roostwell ("we", "us", "our"), including attendance at our workshops, coaching sessions, and community partnership programmes. By booking or attending any Roostwell service, you agree to these terms. Please read them carefully.
1. Definitions
- "Agreement" — these Terms and Conditions, together with our Privacy Policy and Cookie Policy.
- "Service" — any workshop, coaching session, or community partnership programme offered by Roostwell.
- "User" / "you" / "your" — any individual or organisation that books, attends, or accesses a Roostwell service or website.
- "We / Us / Our" — Roostwell, based at 17 Ngamwongwan Road, Bang Khen, Mueang Nonthaburi, Nonthaburi 11000, Thailand.
- "Content" — all materials produced and provided by Roostwell, including workshop slides, prompt cards, checklists, facilitator notes, and glossaries.
- "Educational Content" — all Roostwell Content is strictly informational and does not constitute personal, legal, financial, or other professional advice.
2. Acceptance of Terms
By submitting an enquiry, booking a service, or attending a session, you confirm that:
- You are at least 18 years of age, or are a duly authorised representative of an organisation;
- You have the legal capacity to enter into a binding agreement;
- You have read and understood these Terms and Conditions and agree to be bound by them.
If you are booking on behalf of an organisation, you confirm that you have authority to bind that organisation to this Agreement.
3. Service Description
Roostwell provides the following educational services:
- Conversation Starter Workshop — a facilitated session providing prompts and a glossary to help families hold household planning conversations. Price: ฿3,800 per session.
- Paperwork Coaching Sessions — supportive coaching to help families sort, index, and organise their own household documents. Price: ฿9,000 per visit.
- Community Family Partnership (B2B) — a package for community organisations to deliver general, non-advisory family-planning education to their members. Price: ฿28,500 per organisation (up to 40 members).
All services are strictly educational. Roostwell does not provide personal, legal, financial, or any other form of professional advice. Where professional advice may be required, official channels are signposted.
Services are available in Nonthaburi and surrounding areas. Remote or travel arrangements are by separate agreement.
4. Booking and Payment
4.1 Booking confirmation
A booking is confirmed once Roostwell has acknowledged it in writing (by email or message) and a deposit has been received. Roostwell reserves the right to decline bookings at its discretion.
4.2 Deposit and payment
- A deposit of 50% of the total service fee is required to confirm your booking.
- The remaining balance is due on the day of the session or, for Community Partnerships, prior to the first session.
- Payment is accepted by bank transfer or cash in Thai Baht (฿).
4.3 Cancellation and rescheduling
- Cancellations made more than 7 days before the scheduled session: full deposit refund.
- Cancellations made 3–7 days before the session: 50% of the deposit refunded.
- Cancellations made fewer than 3 days before the session: no refund of deposit.
- Rescheduling requests made more than 48 hours in advance will be accommodated where possible at no charge.
- If Roostwell cancels a session for any reason, a full refund of all amounts paid will be issued within 14 days.
5. User Responsibilities
When using Roostwell's services, you agree to:
- Treat facilitators and other participants with respect throughout the session;
- Not record, photograph, or film any session without prior written consent from Roostwell;
- Not reproduce, distribute, or resell Roostwell's Content without written permission;
- Not use Roostwell's sessions or Content for any commercial purpose other than as expressly agreed in the case of Community Partnerships;
- Provide accurate contact and booking information;
- Arrive punctually for in-person sessions, or notify Roostwell promptly if you are unable to attend.
Roostwell reserves the right to remove any participant from a session who behaves in a way that disrupts the session or makes other participants uncomfortable, without refund.
6. Intellectual Property
All Content created and provided by Roostwell — including prompt cards, glossaries, checklists, facilitator notes, and presentation materials — remains the intellectual property of Roostwell.
Attendees are granted a limited, personal, non-exclusive licence to use take-home materials for their own household planning purposes only. This licence does not permit:
- Reproduction or distribution of Content to third parties;
- Use of Content in any commercial context;
- Modification or adaptation of Content without written consent.
Community Partnership organisations are granted a limited licence to use Roostwell's materials with their own members only, for the duration agreed. This licence is non-transferable and expires at the end of the agreed period.
7. Educational Boundary Disclaimer
Roostwell's services are educational in nature. Nothing provided by Roostwell — verbally, in writing, or via any material — constitutes personal, legal, financial, tax, medical, or any other form of professional advice.
Participants are responsible for their own decisions. Where a topic raised in a session may require professional input, Roostwell will signpost relevant official channels, but takes no responsibility for the suitability or accuracy of external services.
Roostwell makes no representation that any particular outcome will result from attending a session.
8. Limitation of Liability
To the maximum extent permitted by Thai law:
- Roostwell's total liability to you for any claim arising from a service shall not exceed the amount paid by you for that specific service.
- Roostwell shall not be liable for any indirect, consequential, or incidental loss arising from your use of our services or Content.
- Roostwell is not liable for decisions you make based on information provided in sessions.
Nothing in these terms limits liability for death or personal injury caused by Roostwell's negligence, or for fraud or fraudulent misrepresentation.
Force majeure
Roostwell is not liable for failure to deliver a service due to circumstances beyond its reasonable control, including natural disasters, illness of facilitators, or government-imposed restrictions. In such cases, Roostwell will offer an alternative date or a full refund.
9. Indemnification
You agree to indemnify and hold harmless Roostwell and its team members from any claim, loss, or expense (including reasonable legal costs) arising from:
- Your breach of these Terms and Conditions;
- Your misuse of Roostwell's Content or services;
- Any claim by a third party arising from your actions during or after a Roostwell session.
10. Privacy and Data
Your personal data is handled in accordance with our Privacy Policy and Thailand's Personal Data Protection Act B.E. 2562 (PDPA). By booking a service, you consent to the use of your data as described in that policy.
11. Termination
Either party may terminate a booking arrangement before the service is delivered, subject to the cancellation and refund terms in Section 4.3.
Roostwell may terminate any ongoing arrangement (such as a Community Partnership) with 14 days' written notice if a user materially breaches these Terms and fails to remedy the breach within 7 days of being notified.
Sections 6 (Intellectual Property), 7 (Disclaimer), 8 (Limitation of Liability), 9 (Indemnification), and 13 (Governing Law) survive termination.
12. Changes to Terms
Roostwell may update these Terms from time to time. Updated terms will be posted on this page with a revised date. For services already booked, the terms in force at the time of booking apply unless you are notified of a material change and given the opportunity to cancel.
Continued use of our website or services after updated terms are posted constitutes acceptance of those terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from or related to these Terms or Roostwell's services shall be subject to the jurisdiction of the Thai courts.
Informal resolution
Before initiating any formal process, both parties agree to attempt to resolve any dispute informally by contacting Roostwell at [email protected] and allowing 30 days for a response and good-faith discussion.
Consumer protection rights under the Consumer Protection Act B.E. 2522 and related Thai legislation are not affected by these Terms.
14. General Provisions
- Entire agreement: This Agreement constitutes the entire agreement between you and Roostwell regarding our services and supersedes any prior arrangements or understandings.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Roostwell's failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights or obligations under this Agreement without Roostwell's prior written consent. Roostwell may assign its rights in connection with a business transfer.
